Terms of Service
These terms explain how podcast production and audio service projects are scoped, performed, reviewed, and delivered.
1. Services Covered
These Terms of Service apply to podcast audio editing, noise reduction and audio cleanup, mixing and mastering, full podcast production, podcast intro and outro work, show notes and episode descriptions, podcast transcription, social media audiograms, remote podcast recording support, podcast launch packages, and related agreed production work.
2. Project Scope
Each project should begin with a clear scope that identifies the requested service, source materials, expected deliverables, pricing basis, payment requirements, and any important timing considerations. Work outside the agreed scope may require a revised quote or additional approval.
Starting prices shown on the website are informational starting points. They may change when a project requires additional time, unusual restoration work, multiple versions, extensive revisions, rush handling, or deliverables not included in the original request.
3. Client Responsibilities
- Provide complete and usable source files in the agreed format.
- Provide accurate instructions, names, titles, links, timestamps, scripts, brand details, and publishing information where relevant.
- Confirm that the client has the right to use and submit all recordings, music, artwork, trademarks, voice recordings, guest appearances, clips, and other materials.
- Review drafts and provide feedback within the agreed project workflow.
- Keep backup copies of important original files unless another arrangement is confirmed in writing.
4. Recording Quality and Technical Limits
Audio production can improve many common issues, but editing and cleanup cannot guarantee perfect restoration of severely clipped, corrupted, missing, distorted, or poorly captured source material. The result depends in part on the quality and completeness of the files supplied by the client.
Remote recording support can help reduce avoidable problems, but internet conditions, hardware, software, room acoustics, and third-party recording platforms remain outside complete control of Xelmari Audio.
5. Editing, Mixing, and Creative Decisions
Production decisions are made according to the service selected, the client’s instructions, the material provided, and ordinary professional judgment. Clients should identify must-keep sections, sensitive edits, sponsor requirements, legal disclaimers, pronunciation concerns, or other important constraints before production begins whenever possible.
6. Revisions
The number and scope of revisions should be confirmed with the project. A revision generally means a reasonable adjustment to previously completed work based on client feedback. New recordings, major restructuring, changed creative direction, replacement source files, or additions outside the original scope may be treated as new work.
7. Delivery
Final files are delivered in the format and method agreed for the project. Clients should review final files promptly and maintain their own backups after delivery. Long-term archival storage is not guaranteed unless specifically agreed.
8. Publishing Support
Publishing support may include preparation of episode information, file organization, platform-ready materials, or assistance with release steps. Distribution platforms are independent third parties. Their approvals, processing times, account access rules, content policies, availability, and technical performance are outside the control of Xelmari Audio.
9. No Audience or Business Guarantee
Professional production can improve presentation and consistency, but Xelmari Audio does not guarantee downloads, subscribers, rankings, sponsorships, revenue, press coverage, platform placement, audience growth, or other commercial outcomes.
10. Client Content and Portfolio Permission
Clients retain rights they already hold in their original project materials. By supplying materials, the client authorizes Xelmari Audio to process them as needed to provide the requested service. Public portfolio display is not automatic and should occur only when the relevant client permission has been obtained.
11. Payment, Cancellations, and Refunds
Payment obligations are governed by the confirmed project terms and the Payment Policy. Cancellation and refund questions are addressed in the Cancellation & Refund Policy. If project-specific written terms conflict with general website language, the more specific agreed project terms should control to the extent permitted by law.
12. Professional Conduct
Either party may stop or refuse work that would require unlawful conduct, infringement, deception, harassment, unsafe activity, or material that the party is not legally permitted to use or produce.
